End User License Agreement

This agreement is between you and Latro Works ("we", "us"). It applies to Peak Demand and any other game we publish that refers to it, including updates (each a "game"). By installing or playing a game, you agree to this agreement. If you do not agree, do not install or play it.
License grant
We give you a personal, non-exclusive, non-transferable, revocable license to install and play the game for your own non-commercial entertainment, on devices you own or control, as allowed by the store or platform you got it from.
Ownership
The game is licensed, not sold. We and our licensors keep all rights in the game, including its code, artwork, audio, text and names. Third-party components included in the game, such as the Godot Engine and fonts, are provided under their own licenses.
Restrictions
Unless the law allows it despite this agreement, you may not:
- sell, rent, lend, sublicense or otherwise distribute the game
- copy the game, except as needed to install and play it and to make a personal backup
- reverse engineer, decompile or disassemble the game, or extract its assets for reuse
- remove or change any copyright notice or trademark
- use the game for any unlawful purpose
You may stream, record and share videos and screenshots of the game, including on monetised channels, as long as you do not suggest that we endorse you.
Updates
We may release updates that fix problems, change balance or add or remove content. Some updates may be installed automatically by your platform. We are not obliged to provide updates or to keep supporting any version of the game or any device.
Third-party services
The game runs offline and does not connect to our servers. Stores and platforms you use to get or run the game, such as Steam, the Apple App Store or Google Play, provide their own services, such as downloads, payments and backups, under their own terms and privacy policies. We are not responsible for those services.
Termination
This license lasts until it ends. It ends automatically if you break this agreement. You can end it at any time by uninstalling the game and deleting its data. When it ends, you must stop using the game and delete it. The sections on ownership, disclaimers and limitation of liability continue after it ends.
Disclaimers
To the extent the law allows, the game is provided "as is", without warranties of any kind, including that it will be free of errors, run without interruption or work on every device. Some places do not allow these exclusions, so they may not apply to you, and nothing here affects your statutory rights as a consumer.
Limitation of liability
To the extent the law allows, we are not liable for any indirect or consequential loss, or for any loss of data, profit or opportunity, arising from the game. Our total liability to you is limited to the amount you paid for the game. Nothing in this agreement limits liability that cannot be limited by law, such as liability for death or personal injury caused by negligence, or for fraud.
Applicable platform terms
If you got the game from a store or platform, its terms also apply, for example the Steam Subscriber Agreement, the Apple Media Services Terms and Conditions or the Google Play Terms of Service. If this agreement and those terms conflict, the platform's terms apply to the extent of the conflict.
Apple devices
If you got the game from the Apple App Store, the following also applies:
- This agreement is between you and us only, not Apple. We, not Apple, are responsible for the game and its content.
- Your license is limited to use on Apple-branded products you own or control, as allowed by the Usage Rules in the Apple Media Services Terms and Conditions.
- We are responsible for any maintenance and support of the game. Apple has no obligation to provide them.
- If the game fails to meet any applicable warranty, you may notify Apple, and Apple will refund the purchase price, if any. To the extent the law allows, Apple has no other warranty obligation for the game.
- We, not Apple, are responsible for any claims relating to the game, including product liability claims, claims that it fails to meet legal or regulatory requirements, and consumer protection claims.
- We, not Apple, are responsible for investigating, defending and settling any claim that the game infringes someone else's intellectual property rights.
- You confirm that you are not located in a country subject to a U.S. Government embargo or designated as a "terrorist supporting" country, and that you are not on any U.S. Government list of prohibited or restricted parties.
- Apple and its subsidiaries are third-party beneficiaries of this agreement and may enforce it against you.
Changes
We may update this agreement, for example when a game gains new features. The date at the top of this page shows when it last changed. If you keep playing after a change, the updated agreement applies.
